Interesting opinion, Stuck In Spokane!  However, as a retired insurance claim manager for the Northwest quadrant of the U.S. , as a retired hearings officer, and as retired subrogation manager for a local law firm, I am appalled that you take limited hearsay information from another’s review of a police report and make inferences that may or may not be correct.  If you did that while working for me, I'd first try to send you back for additional investigation, and then, barring anything more concrete than what you have, I'd be so concerned about defamation issues and bad faith in the civil arena that we would figure out another means of meeting our goal. Looking forward to seeing how maturity affects your perspective over time!!!
